Terms of Service

1. Acceptance of terms

By downloading, installing, or using the MalParqueao RD application ("the App"), operated by Adonai Garcia under the trade name ViaTechLabs, you accept these terms and conditions in their entirety. If you do not agree with these terms, do not use the App.

This English version of the terms is provided for international users. The Spanish version, available at viatechlabs.com/malparqueao/terms, governs the relationship with users in the Dominican Republic. Both versions describe identical commitments.

2. Minimum age

You must be at least 18 years of age to create an account and use the App. By registering, you represent and warrant that you meet this minimum age. We reserve the right to suspend any account we discover belongs to a minor.

3. Service description

MalParqueao RD is a community-driven platform that allows citizens to report traffic violations in the Dominican Republic through geolocated photos. The App includes a points and ranking system to encourage civic participation. All reports are moderated before being published.

4. Registration and account

To access all features, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized use of your account.

5. Acceptable use

When using the App, you agree to: report only real and verifiable traffic violations, not publish false, misleading, defamatory, offensive, obscene, or hate-promoting content, not harass or intimidate other users, not use the App for illegal purposes, and respect the privacy of other people in the photos you upload. It is strictly prohibited to publish content that shows people's faces in an identifiable way without their consent, sexual or violent content, or content unrelated to traffic violations.

6. Zero tolerance for objectionable content

ViaTechLabs applies a zero-tolerance policy toward objectionable content and abusive behavior. All submitted content goes through a moderation process before being published. Users can report inappropriate content and block other users directly from within the App. Accounts that publish objectionable content will be suspended or removed without prior notice, and their reports will be removed from the platform. We commit to reviewing reports of objectionable content and acting within 24 hours.

7. User content

By uploading photos, videos, or comments to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content within the platform, as well as on the official social media channels of MalParqueao RD (including Instagram, X/Twitter, and other platforms) for educational, civic awareness, and App promotion purposes. You retain ownership of your original content. When publishing content on social media, we may include the location, type of violation, and photograph of the report, but never your personal contact information. We reserve the right to review, moderate, and remove any content that violates these terms.

8. Points and ranking system

Points are awarded for approved reports and community participation. Points have no monetary value and are not transferable or redeemable for money, goods, or services. We reserve the right to modify the points system at any time.

9. Report moderation

All reports go through a review process before being published on the public map. We reserve the right to approve or reject any report based on our criteria for quality and accuracy. The moderation decision is final.

10. License plates

The App allows recording of vehicle license plates as part of reports. This information is provided voluntarily by users and does not constitute a formal complaint to any authority. ViaTechLabs does not verify the accuracy of reported license plates.

11. Anonymized data and commercial access

ViaTechLabs may offer access to aggregated and anonymized data derived from community reports to third parties through paid subscriptions or other commercial agreements. This data will never include information that allows individual users to be identified: usernames, email addresses, and any other personal identifiers are removed before sharing data. Anonymized data may include locations, types of violations, dates, times, and statistical trends. By using the App, you agree that your reports contribute to these anonymized datasets.

12. Legal chatbot with artificial intelligence

The App includes a legal traffic chatbot that answers questions about Dominican regulations using AI language models trained on more than 1,300 official documents (Law 63-17, presidential decrees, INTRANT and DIGESETT resolutions). Each answer cites the exact source so you can verify it.

The chatbot does not constitute legal advice. Answers are an informational guide based on official sources but may contain inaccuracies, omissions, or outdated content. ViaTechLabs does not guarantee absolute accuracy of chatbot answers and is not responsible for decisions made based on them. For real legal cases, consult a licensed attorney in the Dominican Republic.

Chatbot use is limited by quotas (5 initial queries on the Free plan, up to 10/day by earning points through participation, or 50/day with Pro). Abuse of the system (automated queries, scraping bots, quota bypass attempts) may result in immediate account suspension.

13. MalParqueao Pro subscription

The Pro plan is an optional subscription that unlocks expanded chatbot access: 50 queries per day without spending points, saved conversation history, and priority email support. Two billing modes available: $10 USD monthly or $100 USD yearly (equivalent to ~$8.33/mo, saving $20 per year).

The subscription is purchased only via web at viatechlabs.com/pricing. The mobile app does not process payments. Pro access syncs automatically between web and app using the same account email.

The subscription renews automatically at the end of each period (monthly or yearly) unless you cancel before the renewal date. You can cancel at any time from the My account section at viatechlabs.com. Cancellation takes effect at the end of the current billing period — you keep Pro access until that date and the next period is not charged.

Prices are in US dollars (USD). Applicable taxes (Dominican ITBIS, Canadian GST/HST, or other) may be added to the price as required. At the time of subscription, the final total is shown to you before payment confirmation.

Payment processing is handled by Stripe. ViaTechLabs does not store your card details. See Privacy Policy for details.

14. No-refund policy

MalParqueao Pro subscriptions are non-refundable once payment is processed, in full or in part, regardless of how much you used the service during the period. This includes periods you chose not to use the chatbot. Service value is delivered immediately on subscription (access to 50 queries/day, saved history, priority support), so the charge corresponds to service rendered during the contracted period.

What you can do anytime: cancel renewal from the My account section at viatechlabs.com. On cancellation:

• You keep Pro access until the end of the already-paid billing period
• No subsequent periods are charged
• Your account automatically returns to the Free plan when the period expires

By completing your subscription you expressly agree that service starts immediately and waive any cooling-off rights applicable to digital contracts to the extent permitted by law.

Limited exceptions, outside commercial discretion:

• Fraudulent charge: if Stripe identifies or you report an unauthorized charge, a full refund is processed via standard chargeback procedure
• Mandatory consumer rights: if your jurisdiction imposes non-waivable refund rights (certain EU consumers, Quebec, etc.), we apply the legal minimum required

15. Suspension for non-payment

If a renewal fails (expired card, insufficient funds, etc.), Stripe retries the charge up to 4 times over 14 days. During this period we send email notifications to update your payment method. If all 4 attempts fail, your subscription is automatically marked "canceled" and your account returns to the Free plan. You can resubscribe anytime at viatechlabs.com/pricing.

16. Limitation of liability

MalParqueao RD is a citizen-recording tool and does not replace official complaint mechanisms with traffic authorities. ViaTechLabs is not responsible for: the accuracy of reports published by users, actions taken by third parties based on the App's information, data loss, service interruptions, or technical errors.

17. Suspension and termination

We reserve the right to suspend or terminate your account if you violate these terms, without prior notice. You can delete your account at any time from the profile section of the App. Account deletion does not refund active subscriptions — see section 14.

18. Intellectual property

The App, its design, code, logos, and the MalParqueao RD brand are property of ViaTechLabs. Reproduction, distribution, or modification of any element of the App without prior written authorization is prohibited.

19. Modifications

ViaTechLabs reserves the right to modify these terms at any time. Changes will take effect upon being published in the App. Continued use of the App constitutes acceptance of the modified terms. For material changes affecting Pro subscribers (price, query quota, cancellation policy), we will notify by email with at least 30 days notice.

20. Governing law

These terms are governed by the laws of the Dominican Republic. Any dispute will be submitted to the jurisdiction of the competent courts of Santo Domingo, Dominican Republic. For users outside RD, this clause does not limit mandatory consumer rights in your jurisdiction.
